Welcome to Beats Per Minute ("BPM," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of the BPM application (the "App"), which allows you to create Spotify playlists filtered by specific tempo ranges (beats per minute, or "BPM"). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. Acceptance of Terms

These Terms form a legal agreement between you ("you" or "user") and BPM. We may update these Terms from time to time, and the updated version will be effective upon posting within the App or on our website (if applicable). Your continued use of the App after such changes constitutes acceptance of the updated Terms.

2. Description of the App

BPM is an application designed to enhance your Spotify experience by enabling you to create private playlists where songs are filtered based on customized tempo ranges (e.g., 120-140 BPM). The App integrates with Spotify via OAuth authentication, allowing it to:

  • Read your private playlists and liked songs.
  • Access basic profile information for account management.
  • Create new private playlists with BPM-filtered tracks sourced from your Spotify library.

BPM is intended for personal, non-commercial use by individuals such as fitness enthusiasts, meditation practitioners, and productivity-focused users who want music tailored to specific activities or moods.

3. Eligibility

To use the App, you must:

  • Be at least 13 years old (or the minimum age required in your jurisdiction to use Spotify).
  • Have a valid Spotify account.
  • Agree to comply with these Terms and Spotify's Terms of Service.

We reserve the right to refuse access to the App to anyone, at our sole discretion.

4. Spotify Integration

BPM operates by connecting to your Spotify account through Spotify's API and OAuth authentication. By using the App, you authorize us to access and process certain Spotify data, including your playlists, liked songs, and basic profile information, solely for the purpose of providing the App's functionality. You acknowledge that:

  • BPM relies on Spotify's availability, data accuracy (e.g., BPM metadata), and API functionality.
  • Any issues with Spotify's service (e.g., outages or data inaccuracies) may affect the App's performance, and we are not responsible for such issues.
  • You must comply with Spotify's Terms of Service (available at spotify.com/legal) when using BPM.

5. License to Use the App

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes, subject to these Terms. You may not:

  • Modify, reverse-engineer, or distribute the App.
  • Use the App for any illegal or unauthorized purpose.
  • Attempt to access or interfere with our servers or systems.

6. User Responsibilities

You are responsible for:

  • Maintaining the security of your Spotify account and any device used to access the App.
  • Ensuring your use of the App complies with these Terms and applicable laws.
  • The content you source or create via the App (e.g., playlists), including ensuring it does not infringe on third-party rights (e.g., copyright).

You may not use the App to:

  • Harass, spam, or harm others.
  • Collect or misuse data from other users.
  • Overload or disrupt the App's functionality.

7. Intellectual Property

Our Rights: BPM, including its design, code, and branding, is owned by us and protected by copyright and other intellectual property laws. All rights not expressly granted are reserved.

Spotify: Spotify's trademarks, data, and content remain the property of Spotify. BPM's use of Spotify's API does not imply endorsement by Spotify.

User Content: You retain ownership of playlists you create, but grant us a non-exclusive license to process and display them within the App as necessary to provide the service.

8. Privacy

We collect and process certain data to operate the App, as described in our Privacy Policy. By using BPM, you agree to our data practices. Please review the Privacy Policy for details on how we handle your information.

9. Disclaimers

The App is provided "as is" and "as available," without warranties of any kind, express or implied, including:

  • That the App will be uninterrupted, error-free, or secure.
  • That BPM data from Spotify will be accurate or suitable for your purposes (e.g., fitness or meditation).
  • That the App will meet your expectations.

We do not guarantee the availability of Spotify's services or the accuracy of its BPM metadata. BPM is not a fitness, medical, or professional tool, and you use it at your own risk.

10. Limitation of Liability

To the fullest extent permitted by law, BPM and its affiliates, officers, or agents will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including:

  • Loss of data or playlists.
  • Inability to access Spotify or the App.
  • Any reliance on the App's features.

Our total liability, if any, will not exceed $50 USD (or the equivalent in your currency).

11. Termination

We may suspend or terminate your access to the App at any time, without notice, if:

  • You violate these Terms.
  • We discontinue the App or its features.
  • Spotify revokes our API access.

Upon termination, your license to use the App ends, but Sections 7-12 of these Terms will survive.

12. Governing Law

These Terms are governed by the laws of California, United States, without regard to conflict of law principles. Any disputes will be resolved in the courts of California.

13. Changes to the App

We may update, modify, or discontinue the App or its features at any time, with or without notice. We are not obligated to provide ongoing support or updates.
